BuySellOnš¯•¸ is a local marketplace where people list physical items for sale and arrange to meet in person to complete the sale. By browsing, listing, messaging or advertising on BuySellOnš¯•¸, you agree to these Terms and Commerce Policies (together, the "Terms"). If you do not agree, do not use the site.
These Terms include our Prohibited Items list, conduct rules, meetup guidance and Sponsored Ads policy. We may update them as described in Section 12.
BuySellOnš¯•¸ only lets people post listings and contact each other. Every sale is a private agreement between the buyer and the seller.

Listings expire after 20 days. Mark or delete items once they sell.
You may not list, sell, offer, or ask for any of the following. This list is not complete: anything illegal where you or the buyer live is prohibited even if it is not named here.

We may remove any listing we believe is unsafe, illegal or against the spirit of these rules, even if its category is not listed.

You meet other users and pay them at your own risk. We are not present at meetups and are not responsible for what happens there. Follow these guidelines:
Tell us about any user who acts unsafely by using the Report button, and report crimes to local police.
Businesses and individuals can buy Sponsored placements in the feed, and printed ad cards that sellers may include with items.
Use the Report button on any listing, message or ad that breaks these Terms. We review reports as quickly as we can, but we do not monitor all content and cannot promise a response time.
Listings that contain links or look like ads or services may be held for review before they appear. A listing reported by several people may be hidden until we review it.
If you break these Terms, we may, with or without notice:
If you think we made a mistake, email [email protected] within 30 days with your X handle and the listing or ad involved. We will review it once, and our decision is final.
Disclaimer. BuySellOnš¯•¸ is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the site will be uninterrupted, secure or error-free.
Disputes between users. Any dispute over an item, payment or meetup is between you and the other user. You release BuySellOnš¯•¸ and its owners, employees and contractors from all claims arising from those disputes. If you are a California resident, you waive California Civil Code section 1542, which limits releases of unknown claims.
Limitation of liability. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goods, or personal injury or property damage from meetups or items. Our total liability for any claim is limited to the greater of $100 or the ad fees you paid us in the 12 months before the claim.
Indemnity. You agree to defend and reimburse us for claims, losses and legal fees caused by your listings, ads, messages, sales, meetups or breaking these Terms.
Governing law. These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Disputes with us will be resolved in the state courts of Clackamas County, Oregon, or the U.S. District Court for the District of Oregon, unless your local law gives you the right to sue where you live.
Arbitration and class-action waiver. Except as described below, you and BuySellOnš¯•¸ agree that any dispute, claim or controversy arising out of or relating to these Terms or your use of BuySellOnš¯•¸ will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator, not a court, decides questions about the scope and enforceability of this arbitration agreement, to the extent the law allows. The Federal Arbitration Act governs this section.
Small claims. Either party may instead bring an individual claim in small claims court if the claim qualifies and stays in that court.
Class-action waiver. You and BuySellOnš¯•¸ may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person's claims or award relief on behalf of anyone other than the individual party.
Opting out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days after you first accept these Terms, with your name, X handle and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Where non-arbitrable claims go. Any claim that is not subject to arbitration, including claims of users who opted out and any claim a court finds cannot be arbitrated, will be resolved only in the courts named under Governing law above. If the class-action waiver is found unenforceable for a claim, that claim must be decided in those courts and not in arbitration.
Changes. We may update these Terms. We will change the "Last updated" date and, for material changes, show a notice on the site. Continuing to use BuySellOnš¯•¸ after changes take effect means you accept them.
Termination. You may stop using BuySellOnš¯•¸ and delete your listings at any time. Sections 3, 11 and 12 survive termination.
Other. If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a rule is not a waiver. These Terms are the full agreement between you and us about BuySellOnš¯•¸.
